WHAT IS THE AUDITORIO’S COMPLAINTS CHANNEL?

It is a mechanism created by AUDITORIO as part of the enforcement of its compliance policy based on integrity and responsible management for the purpose of allowing the members of the institution and other persons with whom it is associated to report irregular conduct or actions that violate rules or ethics.

WHAT CAN I REPORT?

The complaints channel may be used to report to the institution any incident related to compliance with the Auditorio’s code of conduct or its crime prevention system. Therefore, the Compliance Department may be notified of any irregular, unlawful or criminal conduct that has been observed and that constitutes a violation of the law or a breach of the code of ethics or of the Auditorio’s internal protocol or any matters that are intended to prevent or detect conduct that harms the institution or the committing of criminal acts, providing that such issues have to do with the code of ethics or the crime prevention system in force.

The channel shall also be used to submit queries or concerns regarding the institution’s code of conduct and crime prevention system.

Complaints that refer to matters other than the aforementioned and are unrelated to the purpose of this channel shall be forwarded to the corresponding departments.

Past, present and future matters may be reported through the channel.

WHO OVERSEES THIS CHANNEL?

The channel is overseen by the Compliance Department of AUDITORIO through its compliance officer, who shall be the only party to access the channel. Queries regarding the functioning of the channel may be submitted to canaldedenuncias@auditoriodetenerife.com

WHO MAY SUBMIT A COMPLAINT?

Any individual who is related in some way to Auditorio de Tenerife and has observed a matter that may be reported through the complaints channel, including Auditorio de Tenerife’s employees, suppliers, contractors, customers, and users.

WHAT ARE THE PRINCIPLES GOVERNING THIS CHANNEL?

  1. Independence. The Compliance Department shall oversee the complaints channel.
  2. Objectivity. Matters and circumstances reported through this channel shall be analysed thoroughly and exhaustively.
  3. Confidentiality. The confidentiality of informants and reported parties shall be observed at all times.
  4. Indemnity. No retaliation of any kind shall be taken against those who file complaints, make queries or submit information in good faith, even if the matter reported does not ultimately constitute an irregularity.
  5. Protection of informants. Any harmful action or retaliation taken against informants for using the complaints channel in good faith shall be investigated and sanctioned accordingly by the institution.

WHAT ARE THE CONSEQUENCES OF FILING A COMPLAINT THROUGH THIS CHANNEL?

For every complaint filed, a dossier shall be created. After the Compliance Department has created the dossier and considered the information it has received, it shall determine whether to conduct an internal investigation of the matter or to close the complaint, opting for the latter when it is determined that no violation or irregularity as defined herein has taken place.

Complaints that refer to matters that are unrelated to the purpose of this channel shall, where applicable, be forwarded to the corresponding departments following the closing of the complaint.

CAN I FILE A COMPLAINT ANONYMOUSLY?

Although it is possible to file a complaint anonymously, in such cases, it will not be possible to contact informants for further information if needed, nor to keep them up to date or notify them of the investigation’s results.

Informants who choose to reveal their identities shall be treated confidentially, and their identities shall not be disclosed to third parties not involved in the processing of the complaint. For this reason, it is expressly stated that the right of access is limited to the personal data provided. Informants’ identities shall remain restricted at all times, such that their identifying data shall not be accessible to the reporter or third parties.

Informants’ identities shall be disclosed only to courts, Spain’s tax agency, or competent authorities in the context of an investigation, in accordance with the safeguards set out in applicable legislation.
